Terms of Use

Please read these terms carefully before using Mamaheal — especially the section on medical advice.

1. Acceptance of terms

These Terms of Use ("Terms") form a binding agreement between you and Mamaheal ("Mamaheal," "we," "us," or "our") governing your access to and use of the Mamaheal mobile application (the "App"). By downloading, accessing, or using Mamaheal, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the App.

2. Description of the service

Mamaheal is a wellness and movement companion designed to support postpartum recovery. It offers personalized, adaptive movement plans, guided video demonstrations, daily wellness check-ins, and progress tracking based on information you provide. Mamaheal is a general wellness tool and is not a licensed healthcare service.

3. Not medical advice

Mamaheal does not provide medical advice, diagnosis, or treatment, and nothing in the App should be treated as such. The content, exercises, wellness scores, and recommendations in Mamaheal are for general informational and wellness purposes only and are not a substitute for the advice of your OB-GYN, midwife, pelvic floor therapist, or other qualified healthcare provider.

Postpartum recovery looks different for every body. Before starting any exercise program after birth, please get clearance from your healthcare provider, and continue to follow their guidance throughout your recovery — even where it differs from suggestions in the App.

Stop using the App and consult a healthcare provider promptly if you experience heavy or worsening bleeding, severe or worsening pain, fever, dizziness or fainting, chest pain, shortness of breath, signs of infection, thoughts of harming yourself or others, or any other symptom that concerns you. If you believe you are experiencing a medical emergency, call your local emergency services immediately — do not rely on Mamaheal in an emergency.

4. Eligibility

You must be at least 18 years old and have the legal capacity to enter into these Terms to use Mamaheal. By using the App, you represent that you meet these requirements and that you have received or will seek appropriate medical clearance to participate in postpartum movement activities.

5. Subscriptions & payments

Certain Mamaheal features may require a paid subscription. Where offered, subscription pricing, duration, and any free trial terms will be clearly presented before purchase and are processed securely through the Apple App Store (or another platform we make available).

Subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before the renewal date.
Your payment method will be charged for renewal through your App Store account settings; Mamaheal does not directly process or store your card details.
You can manage or cancel your subscription at any time through your device's App Store account settings.
Refunds are handled according to Apple's refund policies, as we do not have direct access to process payments made through the App Store.
If a free trial is offered, unused portions are forfeited once you purchase a subscription, where applicable.

6. Your responsibilities

When using Mamaheal, you agree to:

Provide accurate information in your onboarding, profile, and daily check-ins so the App can personalize your plan appropriately.
Listen to your body and stop any movement immediately if you feel pain, dizziness, or discomfort beyond normal effort.
Use the App in a safe environment, with enough space and appropriate footing for movement.
Seek your own independent medical judgment and professional care rather than relying solely on the App's suggestions.
Not use the App for any unlawful purpose or in a way that could harm Mamaheal, other users, or third parties.

7. Intellectual property

The App, including its content, design, graphics, video demonstrations, logos, and underlying software, is owned by Mamaheal or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use in accordance with these Terms. You may not copy, modify, distribute, sell, or reverse-engineer any part of the App without our prior written consent.

8. Disclaimer of warranties

The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that any wellness outcome, recovery result, or exercise recommendation will be accurate, safe, or effective for your specific circumstances.

9. Limitation of liability

To the fullest extent permitted by law, Mamaheal and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, health outcomes, or personal injury, arising from or related to your use of, or inability to use, the App — including any injury resulting from exercises or movements performed while using Mamaheal. Your use of the App and any exercise routine is at your own risk. Where liability cannot be fully excluded under applicable law, our total liability will be limited to the amount you paid us, if any, in the twelve (12) months before the claim arose.

10. Indemnification

You agree to indemnify and hold Mamaheal harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the App, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

You may stop using Mamaheal at any time, and may delete your account and data directly within the App. We may suspend or terminate your access to the App if you violate these Terms or if we discontinue the App or any of its features, with notice where reasonably practicable.

12. Changes to these terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, notify you within the App. Your continued use of Mamaheal after changes take effect constitutes acceptance of the updated Terms.

13. Governing law

These Terms are governed by applicable law without regard to conflict-of-law principles. Any disputes arising from these Terms or your use of the App will be resolved in accordance with the laws applicable in your jurisdiction of residence, except where a different arrangement is required by local law.
